This Privacy Policy explains how 50SAAS LLC (d/b/a Octeth) ("Octeth," "we," "us," or "our") collects, uses, and shares information about visitors to and customers of the octeth.com website. It also explains your privacy rights and how the law protects you.
The Self-Hosted Distinction
Octeth is self-hosted software. Our customers install and run Octeth on their own servers and infrastructure. The contacts, subscriber lists, and message data that our customers and their end-clients process using the Octeth software (their "Subscriber Data") live entirely on the customer's own infrastructure and never reach Octeth's systems.
This means: for that Subscriber Data, Octeth is neither the data controller nor a data processor — the customer is the controller and is solely responsible for it. This Privacy Policy therefore covers only the information we collect through our Website and in the course of selling and supporting our software. If you are a subscriber of one of our customers, please contact that customer regarding their handling of your data; we do not hold it.
Who We Are
The data controller for information collected through the Website is 50SAAS LLC (d/b/a Octeth), a Wyoming limited liability company, 1021 E Lincolnway, Suite #5645, Cheyenne, Wyoming 82001, United States. For the purposes of the GDPR, Octeth is the Data Controller of the Website information described in this Policy. You can reach us at [email protected].
Information We Collect
Information you give us
- Contact and inquiry details — your name, email address, phone number, company, and the contents of messages when you request a demo or quote, contact us, or sign up for the Community License or our communications.
- Purchase and billing details — information needed to process an order, such as billing name, company, address, and the information required by our payment processor. We do not store full payment card numbers (see Payment Processing below).
- Account details — if you use a customer or partner portal, the credentials and profile information associated with that account.
Information we collect automatically
- Usage data — your IP address, browser type and version, the pages you visit, referring pages, the date and time of your visit, time spent on pages, and similar diagnostic data.
- Cookies and similar technologies — as described in the Cookies & Analytics section and in our Cookie Policy.
How & Why We Use It
We use the information we collect to:
- Respond to your inquiries and provide demos, quotes, and customer support.
- Process and fulfill your orders, and manage our relationship with you.
- Operate, maintain, secure, and improve the Website and our tools.
- Send you product updates, offers, and marketing communications (subject to your choices — see below).
- Analyze usage and measure the effectiveness of our content and advertising.
- Comply with legal obligations and enforce our agreements.
Legal bases (GDPR). Where the GDPR applies, we rely on: your consent (for example, for non-essential cookies and certain marketing); the performance of a contract (to fulfill orders and provide support); our legitimate interests (to operate, secure, and improve our business and Website, and to market to existing and prospective business customers); and legal obligation (where the law requires us to process or retain data).
Marketing Email & Opt-Out
We may send you newsletters, product updates, and promotional messages about Octeth. We send these using our own Octeth platform. You can opt out at any time by using the unsubscribe link in any message or by contacting us at [email protected]. We will still send you essential, non-promotional messages related to your account or purchases.
Advertising & Remarketing
We use advertising and remarketing technologies (such as pixels and tags from advertising networks) to show you relevant ads about Octeth on third-party sites after you have visited our Website, and to measure the performance of our campaigns. These technologies may set cookies and share certain online identifiers with the advertising networks. Depending on your jurisdiction, this activity may be considered "sharing" or a "sale" of personal information; see the California Rights section for how to opt out. You can also manage interest-based advertising through industry opt-out tools such as the DAA, NAI, and Your Online Choices (EU).
Payment Processing
We use a third-party, PCI-DSS-compliant payment processor to handle payments. We do not collect or store your full payment card details. That information is provided directly to the payment processor, whose handling of it is governed by their own privacy policy. We receive limited confirmation and billing information needed to complete and record your purchase.
Temporary Access to Your Instance
Because Octeth is self-hosted, we do not have standing access to your installation or your Subscriber Data. If, during installation, migration, or a support request, you choose to grant us temporary access to your environment, we will treat anything we access as confidential, use it only to perform the requested work, and not retain it afterward except as required by law. See the Temporary Access & Confidentiality section of the EULA for more.
Retention
We retain the information we collect only for as long as necessary for the purposes described in this Policy — for example, to maintain our customer relationship, comply with legal and accounting obligations, resolve disputes, and enforce our agreements. Usage data is generally retained for a shorter period, except where needed for security or required by law.
Security
We use commercially reasonable technical and organizational measures to protect the information we hold. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
International Transfers
We are based in the United States, and the information we collect through the Website is processed in the United States and in other countries where we or our service providers operate. These countries may have data-protection laws that differ from those in your country. Where required, we use appropriate safeguards for international transfers. By using the Website, you understand that your information may be transferred to and processed in these locations.
Your Rights (GDPR)
If you are in the European Economic Area, the United Kingdom, or a similar jurisdiction, you have the right to: access your personal data; request correction of inaccurate data; request erasure; restrict or object to certain processing (including direct marketing); request data portability; and withdraw consent where processing is based on consent. To exercise these rights, contact us at [email protected]. We may need to verify your identity before responding. You also have the right to lodge a complaint with your local data-protection authority.
Note that if you are a subscriber of one of our customers, your rights regarding the data they hold about you must be exercised with that customer, as they (not Octeth) control that Subscriber Data.
California Rights (CCPA/CPRA)
If you are a California resident, you have the right to: know what personal information we collect, use, and disclose; request access to and deletion of your personal information; correct inaccurate personal information; and opt out of the "sale" or "sharing" of personal information (which, under California law, can include the use of certain advertising and remarketing technologies). We do not discriminate against you for exercising these rights.
To exercise your California rights, including to opt out of "sale"/"sharing," contact us at [email protected], or use the advertising opt-out tools listed in the Advertising & Remarketing section. We will respond to verifiable requests as required by law.
Do Not Track. Our Website does not currently respond to browser "Do Not Track" signals, but we honor recognized opt-out preference signals where required by law.
Children's Privacy
The Website and our products are intended for businesses and are not directed to children. We do not knowingly collect personal information from children under 16. If you believe a child has provided us with personal information, please contact us and we will take appropriate steps to delete it.
Changes & Contact
We may update this Privacy Policy from time to time. We will post the updated version here with a new "Last updated" date and, where appropriate, provide additional notice. Please review it periodically.
